Refund Policy for Promosoundgroup

This Refund Policy ("Policy") is provided by FloyaraMusic OÜ (Reg code: 16341789), Harju maakond, Kuusalu vald, Pudisoo küla, Männimäe/1, 74626 Estonia, operating under the trade name "PromosoundGroup" ("we", "us", "our"). This Policy governs all refund requests for digital promotion services purchased through promosoundgroup.net.

1. General Provisions

All products and services offered on promosoundgroup.net are digital services that are inherently non-tangible and non-reversible. Once an order has been finalized and the service delivery has commenced, we are generally unable to offer refunds. We strongly encourage all customers to thoroughly review the nature, scope, and description of the service prior to completing a purchase.

By placing an order, you confirm that you understand the digital nature of the services, the terms under which they are provided, and the limitations on refunds as described in this Policy.

2. Eligibility for Refund

2.1 Non-Delivery Due to Company Error

In the event that we fail to deliver the purchased service entirely due to an error attributable to PromosoundGroup, a full refund will be issued. You must report non-delivery to our support team at support@promosoundgroup.net within seven (7) calendar days from the original order date. Failure to report within this timeframe will result in the order being deemed fulfilled and ineligible for a refund.

2.2 Material Service Discrepancy

Should the delivered service materially deviate from the description as presented on the relevant product page at the time of purchase, you may request a partial or full refund within seven (7) calendar days of your purchase date. You must provide substantive evidence of the discrepancy, including screenshots, analytics data, or other objective documentation to facilitate our assessment.

2.3 Partial Service Execution

Where a service has been partially executed but not completed in full due to circumstances within our control, a partial refund proportionate to the undelivered portion may be approved. Such requests must be submitted within thirty (30) calendar days of the purchase date. The proportionate amount shall be calculated based on the total price of the order and the extent of service already delivered.

3. Circumstances Excluding Refund Eligibility

Refunds will not be granted in the following circumstances:

(a) The service has been fully delivered in accordance with its product description;

(b) You have altered your username, profile name, profile ID, URL, or any similar account identifiers after initiating a promotional campaign, thereby disrupting or preventing successful delivery;

(c) You have ordered promotional services from third-party providers simultaneously with a PromosoundGroup campaign, in violation of our Terms of Service;

(d) Decreases in engagement metrics (including but not limited to unfollows, unsubscribes, reduced views, or decreased play counts) occurring after service delivery has been completed;

(e) Natural fluctuations in social media engagement or algorithmic changes implemented by third-party platforms beyond our control;

(f) The refund request is submitted outside the applicable timeframe specified in Section 2;

(g) The service falls within the scope of exemptions from the EU right of withdrawal as set forth in our EU Right of Withdrawal Policy; or

(h) The request constitutes or is associated with a fraudulent dispute, chargeback, or misrepresentation.

4. Refund Assessment Process

Each refund request is subject to thorough evaluation by our operations team. The assessment process is as follows:

(a) Submission: Submit your refund request via email to support@promosoundgroup.net, including your order number, a description of the issue, and any supporting evidence;

(b) Review: Our team will assess the request against the criteria set forth in this Policy. We may request additional information or documentation during this process;

(c) Decision: A determination will be communicated to you within five (5) business days of receiving all necessary information. The decision shall include the reasons for approval or denial;

(d) Processing: If approved, the refund will be processed and credited to your original method of payment within fourteen (14) calendar days. The exact timeline may vary depending on your payment provider.

5. Deductions from Refunds

Where a refund is granted for an order for which service performance has already commenced, we reserve the right to deduct from the refund amount any costs already incurred in connection with the order, including but not limited to:

(a) Employee labor and operational expenses;

(b) Service fees paid to third-party partners and platform providers;

(c) Technology and infrastructure costs allocated to the order; and

(d) Any other direct expenditures attributable to the partial execution of the service.

The deducted amount shall be reasonable and proportionate to the work performed and resources committed up to the point of the refund request.

6. Fraudulent Disputes and Chargebacks

By purchasing from PromosoundGroup, you confirm your understanding of the services being purchased and agree not to file fraudulent disputes or chargebacks with payment providers or financial institutions. Filing a fraudulent chargeback constitutes a material breach of our Terms of Service and may result in:

(a) Permanent suspension of your account and denial of future services;

(b) Recording of your IP address and associated identifiers for fraud prevention purposes; and

(c) Pursuit of all available legal remedies, including recovery of the disputed amount, associated fees, and costs of investigation and litigation.

We reserve the right to contest any chargeback that we determine to be unjustified and to provide the relevant payment provider with evidence of service delivery.

7. EU Consumer Rights

If you are a consumer located in the European Union or the European Economic Area, your rights under EU consumer protection law, including the right of withdrawal, are governed by our EU Right of Withdrawal Policy, which should be read in conjunction with this Refund Policy. In the event of any conflict between this Policy and the EU Right of Withdrawal Policy regarding rights of EU/EEA consumers, the EU Right of Withdrawal Policy shall prevail.

Nothing in this Policy is intended to limit your statutory rights under Directive (EU) 2019/770 on the supply of digital content and digital services, or any other mandatory provisions of applicable EU consumer protection law.

8. Limitation of Liability

Our aggregate liability for any refund or claim arising under this Policy shall not exceed the total amount actually paid by you for the specific service giving rise to the refund request. This limitation applies regardless of the basis of the claim, whether in contract, tort, or otherwise.

9. Amendments

PromosoundGroup reserves the right to amend this Policy at any time. Changes will be effective immediately upon posting on our website. It is your responsibility to review this Policy periodically. Continued use of our services following the posting of changes constitutes your acceptance of such changes. Amendments will not apply retroactively to orders placed prior to the effective date of the change.

11. Applicable Law

This Policy is governed by and construed in accordance with the laws of the Republic of Estonia. Any dispute arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the Estonian courts, subject to applicable mandatory consumer protection provisions.
